PRIVACY POLICY (Effective Date July 2022)

8DIO PRODUCTIONS LLC (“8DIO”) recognizes that the careful handling of the personal information you entrust to us is important and that you have the right to understand our Privacy Policy prior to providing us with any information that could be used to identify you (“Personally Identifiable Information”).  8DIO has adopted this Privacy Policy to explain how and why we collect particular information.

What Type of Information We Collect and How We Use It?

Our policy is to collect and use only the most necessary information for processing your order, providing support to you, providing you with marketing material, and detecting, preventing, mitigating and investigating fraudulent or unlawful activities.  The Personally Identifiable Information may include information you give us when you register or purchase through our website, such as your name, email address, and payment related information and may also include information you supply when interacting with our customer services team including details we require to contact you.  It may also include device identifiers such as internet protocol (IP) address and internet service provider (ISP).  By using the Soundpaint website or supplying the information, you consent to the collection, use and disclosure of your Personally Identifiable Information as set forth in this Privacy Policy.

We do not sell or rent the information you supply to any third party. We share Personally Identifiable Information that we receive solely for the purposes described below:

  1. In cases where the disclosure is required by law, 8DIO may share information with third parties necessary to meet this obligation.  When a crime, abuse, or violation of the 8DIO license agreement is suspected, 8DIO retains the right to disclose information as necessary to enforce its rights and to address fraud, security or technical issues.
  2. Other service providers, partner companies and individuals performing functions on our behalf may have access to personal information to perform specified tasks.  8DIO relies on third party affiliates and other trusted businesses and individuals to provide tools to optimize our website functionality, to analyze performance, to communicate with you, to provide a personalized experience to you, and to help improve the safety and reliability of our services.  An example of this includes payment processing (credit card, direct debit).  While 8DIO is not responsible for the privacy practices of these other websites, apps and services,  8DIO undertakes to the extent reasonably possible to engage reputable service providers, partner companies and individuals performing any functions on our behalf and will to the extent reasonably possible oblige such service providers to use your personal information only for the limited purposes of performing the specified tasks and to treat the information in accordance with this Privacy Policy.  The cookie collection or other local storage systems of our third-party service providers and partner companies performing key functions on our behalf may be viewed and your consent preferences managed here.  If you have previously indicated your preferences regarding the acceptance of cookies on our website, you may need to clear your cookies to return to the preferences dialog. 

Social Media Sharing Tools and Links to Other Websites

You may find links to other websites, apps and services, such as Facebook, YouTube, SoundCloud, Twitter, PayPal and Google Wallet.  Please note that when you click on one of these links, you are entering another website for which 8DIO has no responsibility and we recommend that you review the privacy policies of each of these websites, apps or services before providing Personally Identifiable Information through any link from 8DIO’s Soundpaint website.

Security

We attempt to follow policies and procedures that will protect against unauthorized access to your Personally Identifiable Information and reduce the risks of loss, misuse, unauthorized access, disclosure and alteration.  We minimize the amount of personal information we disclose to what is directly relevant and necessary to accomplish the specified purpose.  For example, we do not store credit card details.  Nevertheless, no data transmission over the Internet is 100% secure.  While we strive to protect your information, we can make no guarantees or warranties regarding its security.

Rights to Access, Modify, and Erase Personal Information and Right to Lodge A Complaint

Upon request, 8DIO will provide you with information about whether we hold any of your Personally Identifiable Information.  Our website gives you the opportunity to access and delete your Personally Identifiable Information that you have provided to us. 

You have the right to object to and opt out of certain uses and disclosures of your Personally Identifiable Information.  Where you have consented to 8DIO’s processing of your Personally Identifiable Information, you may withdraw that consent at any time and opt out of further processing by contacting tawnia@8dio.com.  Nevertheless, 8DIO may still collect and use your Personally Identifiable Information for the establishment, exercise, or defense of legal claims, and you may also continue to receive non-promotional communications regarding 8DIO and the services we provide to you and you will not be able to opt out of those communications (e.g. communications regarding updates to our Terms or this Privacy Policy).

If you have signed up for the 8DIO newsletter, we have collected your full name and email address.  The emails that we send contain links that enable you to “unsubscribe” from such mailings at any time.

Data Retention

We retain your Personally Identifiable Information as long as it is necessary and relevant for our operations. When we determine the maximum retention duration of any Personally Identifiable Information we hold we do so with regard to our legitimate interests to retain data, our obligation under GDPR to minimize data we hold with what we do hold as personal data being kept proportionate, with due consideration of the nature, and sensitivity of the personal data and the potential risk of harm from unauthorized use or disclosure of your personal data.

Changes to Our Privacy Policy and Practices

Our Privacy Policy may change from time to time. We will post any changes to the Privacy Policy on this page and archive prior versions of this Privacy Policy for your review.  We will announce any material changes and their rationale to this Privacy Policy through email.
